Terms and Conditions of Business

Monarch provides marketing consultancy and related services, including but not limited to:
Marketing strategy
Brand strategy
Content strategy
Social media consultancy
Website design and development
Campaign planning
SEO consultancy
Email marketing consultancy
Market research
Personal branding
Ongoing marketing support
Services will be delivered as outlined in the relevant proposal, invoice, service description, or written agreement.

The scope of work shall be limited to the deliverables expressly stated in the proposal or agreement.
Any work requested outside the agreed scope shall be treated as additional work and may incur additional fees.
Monarch reserves the right to decline requests that fall outside the agreed scope.

The Client agrees to:
Provide accurate information
Supply requested materials promptly
Review deliverables within agreed timescales
Respond to communications in a timely manner
Ensure they have rights to any content provided
The Client acknowledges that delays in providing information may delay project completion.

All fees are stated in GBP unless otherwise specified.
Payment terms may include:
Fixed Price Services
Payment is required in full before work begins unless otherwise agreed.
Custom Projects
A deposit may be required before commencement.
The remaining balance shall be payable according to agreed milestones or invoice terms.

Invoices must be paid within the stated payment period.
Where payment is overdue, Monarch reserves the right to:
Suspend work
Withhold deliverables
Pause access to project files
Charge statutory interest under the Late Payment of Commercial Debts legislation
Recovery costs may also be added where permitted by law.

Deposits are non-refundable.
Upon receipt of a deposit, Monarch reserves time, resources, and scheduling capacity for the Client.

Estimated timelines are indicative only.
Monarch shall not be liable for delays caused by:
Client delays
Third-party providers
Platform outages
Force majeure events

If the Client becomes unresponsive for more than 30 consecutive days:
Monarch may:
Pause the project
Reallocate resources
Charge a restart fee
If no communication is received for 90 consecutive days, the project may be considered abandoned.
No refunds shall be due for abandoned projects.

Unless otherwise agreed:
Consultancy services include clarification questions only
Strategy documents include one revision round
Website projects include two revision rounds
Additional revisions shall be charged separately.
A revision is defined as a modification to existing work and not a request for entirely new work.

Consultation bookings are reserved specifically for the Client.
Rescheduling requests require at least 24 hours' notice.
Failure to attend a booked consultation may result in forfeiture of the session fee.

Monarch does not guarantee:
Revenue increases
Sales volumes
Lead generation outcomes
Search engine rankings
Social media growth
Advertising performance
Marketing outcomes depend upon numerous external factors beyond our control.
All recommendations are provided in good faith and based on professional judgement.

Where website services are provided:
Monarch is responsible only for the agreed project scope.
Unless expressly stated:
Monarch is not responsible for:
Ongoing maintenance
Security monitoring
Hosting
Domain registration
Software licensing
Content updates after launch

Projects may involve third-party services such as:
Squarespace
WordPress
Stripe
Google Workspace
Meta
Google Ads
Email marketing platforms
The Client remains responsible for:
Third-party subscription fees
Platform costs
Account ownership
Monarch shall not be liable for third-party failures, outages, policy changes, or account restrictions.

Upon full payment:
The Client receives ownership of final approved deliverables unless otherwise agreed.
Monarch retains ownership of:
Methodologies
Frameworks
Templates
Internal processes
Proprietary systems
These may not be resold, distributed, or reproduced without permission.

Unless agreed otherwise, Monarch may display completed work within:
Portfolio materials
Website case studies
Marketing materials
Social media content
Confidential information shall not be disclosed.

The Client warrants that all materials supplied:
Are lawful
Do not infringe third-party rights
May legally be used by Monarch
The Client indemnifies Monarch against claims arising from materials supplied by the Client.

To the fullest extent permitted by law:
Monarch's total liability shall not exceed the fees paid by the Client for the relevant service.
Monarch shall not be liable for:
Indirect losses
Consequential losses
Lost profits
Lost revenue
Lost opportunities
Reputational damage

Both parties agree to keep confidential information confidential.
This obligation survives termination of the relationship.

Monarch shall not be liable for delays or failures caused by circumstances beyond reasonable control, including:
Natural disasters
Power outages
Cyber incidents
Illness
Government action
Internet failures

Either party may terminate an ongoing agreement in writing.
Where work has already been completed, fees remain payable.
Deposits remain non-refundable.

Due to the nature of consultancy and digital services:
Completed work is non-refundable
Time already spent is non-refundable
Deposits are non-refundable
Refund requests shall be assessed solely at Monarch's discretion.

These Terms shall be governed by and interpreted in accordance with the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

These Terms and Conditions govern the supply of services by Monarch Marketing Consultancy ("Monarch", "we", "us", "our") to any client ("Client", "you", "your").
By purchasing services, booking consultations, paying invoices, signing proposals, or otherwise engaging our services, you agree to these Terms.
